What’s in the GENIUS Act?

The Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act is the clearest federal signal yet that stablecoins are here to stay—but only under strict rules.

Key provisions include:

  • Only “permitted issuers” can offer payment stablecoins, defined as digital assets redeemable at a fixed dollar value.

  • Issuers must:

    • Be an FDIC-insured depository institution, or

    • Be a federally qualified nonbank payment issuer, or

    • Operate under a state-qualified stablecoin framework with restrictions.

  • Reserves must be held 1:1 in high-quality liquid assets, primarily U.S. dollars and Treasury bills.

  • Monthly public disclosures of reserves and redemption procedures are required.

  • State-based issuers may not exceed $10 billion in outstanding stablecoins without federal oversight.

  • Federal regulators (e.g., the Federal Reserve, OCC) are empowered to supervise and coordinate enforcement.
